Terms of use

This Terms and Conditions Agreement (‘Agreement’) governs your access to and use of the software product (‘Product’) provided by BusinessEye Softwares, located in Ahmedabad, India (‘Provider’). By accessing or using the Product, you agree to be bound by this Agreement. If you do not agree with these terms, you may not use the Product.

1. Use of the Product
  • 1.1 License. The Provider grants you a non-exclusive, non-transferable license to use the Product for your internal business purposes, subject to the terms and conditions of this Agreement.
  • 1.2 User Responsibilities. You are solely responsible for the content and legality of the data, attachments, and messages sent using the Product. You agree to comply with all applicable laws and regulations when using the Product.

    • 2. Intellectual Property
  • 2.1 Ownership. The Product, including all intellectual property rights, remains the property of the Provider. This Agreement does not grant you any rights to the Provider’s trademarks, logos, or other proprietary information.
  • 2.2 User Content. You retain ownership of the content you upload to the Product. By using the Product, you grant the Provider a worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content for the purpose of providing the Product and related services.

    • 3. Data Collection and Privacy
  • 3.1 Data Collection. The Product may collect and store data, including personal information, to provide analytics and reports. The Provider will handle all data in accordance with its Privacy Policy, which is incorporated by reference into this Agreement.
  • 3.2 Confidentiality. The Provider will use commercially reasonable efforts to protect the confidentiality of your data. However, the Provider cannot guarantee the security of data transmitted over the internet.

    • 4. Limitation of Liability
  • 4.1 Disclaimer. The Product is provided ‘as is’, without any warranties, express or implied. The Provider disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • 4.2 Limitation of Liability. The Provider and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Product, even if advised of the possibility of such damages.

    • 5. Termination
  • 5.1 Termination. The Provider may suspend or terminate your access to the Product at any time, without prior notice, for any reason or no reason.
  • 5.2 Effect of Termination. Upon termination, you must cease all use of the Product and delete any copies of the Product in your possession.

    • 6. Governing Law and Jurisdiction
  • 6.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of India.
  • 6.2 Jurisdiction. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, India.

    • 7. Miscellaneous
  • 7.1 Entire Agreement. This Agreement constitutes the entire agreement between you and the Provider regarding the Product and supersedes any prior agreements or understandings.
  • 7.2 Modifications. The Provider reserves the right to modify or update this Agreement at any time. The modified Agreement will be effective upon posting on the Provider’s website or notifying you through the Product.

    • By using the Product, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
